It's important to hire a disability lawyer to help you

Fighting for your long-term disability benefits on your own can be an isolating and discouraging experience. A disability law firm can offer you a strong, supportive, and empathetic team of legal professionals dedicated to your case. They can help you gather all the necessary medical records and documents to build a strong case. Their team of experts can help you understand the intricacies of the legal system you might find overwhelming on your own.

Knowledge and Experience in the Appeals Process

Even with an excellent application, there is sometimes a chance for your claim to be denied. Receiving a denial letter can be demoralizing. But don't worry, a disability law firm can help you appeal your denial. Their knowledge of the appeals process and the legal requirements for a successful appeal is vital. The law firm has experienced appeal attorneys that can help you file your appeal on time and ensure all the rules and regulations of the process are followed to maximize your chance of success in the appeal process.

A Better Chance of Success

Many people cannot afford to get the time off work to go and apply or appeal their denied benefits claim. There is a lack of time, and it can be exhausting to fight for one’s legal rights. With a disability law firm, you increase your chances of getting approved for your long-term disability benefits significantly. With correct legal representation, you can receive your long-term disability benefits with ease.

How Long Does Long Term Disability Coverage Last?

Although each long-term disability insurance plan is different, most policies provide LTD benefits for a period of up to two years should you remain unable to return to the job that you were in at the time that you became disabled. After two years, the test for disability often changes such that to qualify, you must be unable to perform the duties of any job for which you are reasonably qualified (regardless of availability).

Long-term disability insurance benefits usually begin once short-term disability insurance, sick leave benefits from your employer, and/or Employment Insurance sickness benefits end. Most long-term disability plans will replace 60 to 70 percent of your regular income.

Long Term Disability Benefit Exclusions

Many LTD policies have “exclusions”, which your insurer may try to rely upon to deny you benefits, even if you would otherwise be covered.

The most common exclusions pertain to pre-existing conditions, i.e. medical conditions which affected you prior to you being covered by the policy.  Sometimes these exclusions will only apply for the first two years you are covered by the policy.
Every policy is different, and the wording of these exclusion clauses can be tricky, even for trained professionals. You need competent representation to ensure that you are being treated fairly.

common questions and answers about LTD Benefits.

Get answers to common questions about LTD Benefits claims in Ontario, including insurance coverage, time limits, compensation, and your legal rights after a rideshare accident.
What is an “invisible illness” in an Ontario long-term disability (LTD) claim?

An “invisible illness” is a condition that may not show obvious outward signs but can still be disabling. People often use this term for conditions like chronic pain, fibromyalgia, chronic fatigue, migraines, long COVID symptoms, PTSD, depression/anxiety, and other conditions where your limitations may not be visible to others.

Why do insurance companies deny LTD claims for invisible illnesses?

This is one of the most common issues in LTD denials. Insurers may deny or cut off benefits because they claim:

  • There’s “not enough objective evidence”
  • Your symptoms are “subjective”
  • You can still work because you “look fine”
  • Your treatment isn’t “aggressive enough”
  • Your restrictions/limitations aren’t clearly documented

A denial doesn’t mean you’re not disabled—it often means the insurer is challenging the proof.

What should I do if my LTD benefits are denied for an invisible illness in Ontario?

Don’t give up. Start by:

  • Getting the denial letter in writing and noting all deadlines
  • Requesting a copy of your full LTD policy and claim file
  • Continuing treatment and following medical advice
  • Gathering medical records and documenting how symptoms affect daily function
  • Speaking with a lawyer before you submit an appeal or additional forms
What evidence helps prove an invisible illness for LTD benefits?

Insurers often focus on whether your evidence clearly explains functional limits (what you can’t do reliably and consistently). Helpful evidence can include:

  • Detailed doctor/specialist reports describing restrictions and limitations
  • Symptom logs (fatigue, pain, migraines, brain fog, flare-ups)
  • Functional capacity evaluations (when appropriate)
  • Treatment history (medications, therapy, rehab, pain clinic)
  • Workplace impact (attendance issues, inability to sustain tasks, cognitive limits)
What does “objective evidence” mean for LTD—and what if my condition doesn’t show up on tests?

Many invisible illnesses don’t have a single definitive test. Even so, you can still build a strong claim by showing consistent medical documentation, credible clinical findings, and clear functional limitations over time. The goal is to prove disability through the full medical picture, not just one test result.

Can surveillance or social media be used against me in an invisible illness LTD claim?

Yes. Insurers sometimes use surveillance or online posts to argue you’re more capable than you claim. A short clip or a single “good day” can be taken out of context. Legal guidance can help you respond properly and keep the focus on your real, day-to-day limitations.

Cariati Law can review the denial, identify what evidence the insurer says is missing, help you strengthen the medical and functional proof, handle insurer communications, and pursue the best path forward—whether that’s an appeal or legal action.
